Equipment Rental Agreement & Terms and Conditions

TERMS AND CONDITIONS These Terms and Conditions, the rental document signed by you, and a return record with computed rental charges together constitute the rental agreement between you and Medical Supplies And Services ("Company", "we", "our", "us"). "I", "me", "my" refer to the Customer who signs this agreement. "You" and "your" refer to Medical Supplies And Services. 1. Equipment Return The equipment shall be returned to the agreed return location stated on this rental document. A rate change or special charges may apply if returned to a different location. You will be responsible for all costs associated with returning equipment to our location if you choose a location other than the one agreed upon in this document. It is the renter's responsibility to contact Medical Supplies And Services at least 48 hours in advance to schedule equipment pickup. A late charge per day will be assessed based on the daily rental rate of the item. 2. Damage & Loss You are responsible for all loss or damage to the equipment regardless of fault (unless prohibited by law), whether due to collision, vandalism, theft, or any other cause. If the equipment is stolen or damaged, you shall pay its fair market retail value before the incident less salvage, or repair costs plus diminution in value, whichever is lower. You are also responsible for loss of use during reasonable downtime and a reasonable administrative fee as determined by Medical Supplies And Services or as specified by law. Your responsibility for loss or damage remains regardless of whether the incident was caused by misuse, reckless operation, operating under the influence of alcohol or a controlled substance, failure to report an accident, fraudulent misrepresentation, or use of the equipment for an illegal purpose. 3. Prohibited Use You agree not to use, or permit the use of, the equipment in any manner inconsistent with its original design and intended purpose. You acknowledge that you have been properly instructed in the correct use of the rented equipment. Any violation of this clause automatically terminates your rental and makes you liable for all applicable penalties, fines, forfeitures, liens, recovery and storage costs, including all related legal expenses. 4. Indemnification You agree to indemnify Medical Supplies And Services for any loss, liability, and expense arising from the use of the equipment that results from any unauthorised or prohibited operation. Except in the event of the Company's gross negligence, you accept full responsibility for bodily injury, property damage, death, and financial loss sustained by any person arising out of your use of the equipment. You further agree to indemnify Medical Supplies And Services for all costs, including reasonable attorney's fees, incurred in defending any related claims. Only the persons expressly named on this agreement may use the equipment. 5. Repossession Medical Supplies And Services reserves the right to repossess the equipment at any time it is found being used in violation of the law or the terms of this agreement, or if it appears to have been abandoned, or if we discover you provided misleading information to obtain the equipment. Advance notice is not required.6. Collections & Late Charges All charges, fees, and expenses — including payment for loss of or damage to the equipment — are due upon demand. If payment is not made when due, a late charge of 1.5% per month (or the maximum rate permitted by law) will be applied to the outstanding balance. You also agree to pay any collection costs, including a service charge for any dishonoured cheque and our reasonable attorney's fees. 7. Credit Card Reserve You acknowledge that your credit information will be retained on file until the equipment is returned and all charges have been settled. 8. Property Left in Equipment Medical Supplies And Services is not responsible for any loss of or damage to personal property left in or on the equipment, on our premises, or received or handled by us, regardless of fault. You will be responsible for any claims made by third parties for such loss or damage. 9. Online Marketplace Rentals Rentals facilitated through online marketplace platforms are governed both by this Agreement and the platform's own rental agreement. In such bookings, Medical Supplies And Services acts as an independent rental partner and is solely responsible for the quality, maintenance, safety, and compliance of the rented equipment. The platform acts solely as a marketplace facilitator and is not party to the rental contract between you and Medical Supplies And Services. Cancellation, damage waiver, and other platform policies shall apply as published on the respective platform at the time of booking. 10. Governing Law & Disputes This agreement shall be governed by applicable law. Any disputes arising from this agreement shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration or the appropriate court of jurisdiction as required by law. RENTAL PICKUP NOTICE Once your rental period is complete, our standard scheduled pickup time is 2:00 PM on your confirmed pickup date. Please ensure the equipment is ready and accessible at that time. In some cases, our pickup team may experience delays beyond the scheduled time due to high order volumes and back-to-back fulfillment commitments. We appreciate your patience in such situations. Please do not remove the name tag attached to your rental item, as it is used by our team to identify and verify equipment during pickup. Removing it may cause delays or errors in the collection process
